End User License Agreement

Agreement
This End User License Agreement ("EULA") is a legal agreement between you ("User") and BlackAtlas LLC ("BlackAtlas") governing your use of BlackAtlas software and hardware products. By using any BlackAtlas product, you agree to the terms of this EULA.
Software Licenses
AtlasRF Software: The software included with AtlasRF hardware is licensed, not sold. You are granted a non-exclusive, non-transferable license to use the software on the hardware unit it was delivered with. You may not reverse engineer, decompile, or disassemble the proprietary components of the software.
GridDown Software: GridDown is dual-licensed. The open-source version is available under the GNU General Public License v3.0 (GPL-3.0). A commercial license is available for organizations that require proprietary deployment or wish to integrate GridDown into commercial products without GPL obligations. Hardware-specific integrations and pre-configured deployments included with BlackAtlas hardware are subject to this agreement. Contact info@blackatlas.tech for commercial licensing.
Hardware Warranty
BlackAtlas-Manufactured Hardware (AtlasRF)
BlackAtlas warrants that BlackAtlas-manufactured hardware products (AtlasRF Standard and AtlasRF Pro) will be free from defects in materials and workmanship for a period of one (1) year from the date of delivery ("Warranty Period"). During the Warranty Period, BlackAtlas will, at its sole discretion, repair or replace any defective hardware at no charge.
Third-Party Hardware Bundles (GridDown)
GridDown hardware bundles include third-party components (Samsung tablets, Satechi hubs, RTL-SDR receivers) that carry their original manufacturer's warranty. BlackAtlas does not provide an independent hardware warranty on third-party components. BlackAtlas warrants that all hardware bundles will arrive with software properly installed and configured, and will resolve any configuration or installation defects within 30 days of delivery at no charge.
Secure Messenger Hardware (Affiliate)
The T-Deck CYPHER M8K hardware for GridDown Secure Messenger is sold directly by Rokland via an affiliate link; BlackAtlas does not sell, ship, configure, or warrant the device. All warranty, returns, shipping, and support questions for the hardware must be directed to Rokland. The GridDown Secure Messenger firmware itself is provided free of charge under its applicable license terms and is subject to the same "AS IS" provisions as other BlackAtlas software.
Software
All software — including GridDown, GridDown Secure Messenger, and AtlasRF software — is provided "AS IS" without warranty of any kind. Software updates are provided as described in the applicable license terms.
The BlackAtlas hardware warranty does NOT cover:
- Damage caused by misuse, accident, neglect, or unauthorized modification
- Damage from operating outside the product's rated environmental specifications
- Normal wear and tear, including antennas and cables
- Damage caused by use with non-approved accessories or power supplies
- Software issues unrelated to hardware defects
- Products with removed or altered serial numbers
- Third-party hardware components (covered by their respective manufacturer warranties)
Disclaimer of Warranties
EXCEPT FOR THE EXPRESS WARRANTY ABOVE, ALL PRODUCTS AND SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
BLACKATLAS SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, LOSS OF REVENUE, LOSS OF BUSINESS, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OR INABILITY TO USE OUR PRODUCTS. IN NO EVENT SHALL BLACKATLAS'S TOTAL LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT.
Permitted Use
BlackAtlas products are designed for lawful use only. You agree to use all products in compliance with applicable local, state, federal, and international laws and regulations, including but not limited to FCC regulations, FAA regulations, and export control laws.
You are solely responsible for ensuring your use of RF monitoring equipment complies with all applicable laws regarding radio frequency reception in your jurisdiction.
Passive Operation Requirement
AtlasRF is designed, tested, and licensed exclusively as a passive, receive-only RF monitoring system. You may not connect, integrate, or otherwise use AtlasRF in conjunction with any active transmitting sensor — including but not limited to radar systems, RF jammers, signal emitters, direction-finding transmitters, or any device that radiates intentional RF energy for the purpose of detecting, tracking, or locating aircraft, drones, vessels, or vehicles — without prior written authorization from BlackAtlas LLC.
Connecting active transmitting equipment to AtlasRF without authorization voids all regulatory compliance assumptions, may violate federal law (including but not limited to 6 U.S.C. § 124n and 18 U.S.C. § 32), and constitutes a material breach of this EULA. BlackAtlas LLC assumes no liability for any legal, regulatory, or safety consequences arising from unauthorized use of active sensors with AtlasRF.
AtlasRF includes technical safeguards to enforce this requirement. If the system detects the presence of unauthorized active transmitting equipment connected to or operating in conjunction with the AtlasRF platform, the system may automatically cease to function until the violation is resolved. Restoration of functionality following such an event may require direct coordination with BlackAtlas LLC and is not guaranteed.
This restriction does not apply to passive receive-only accessories included with or recommended for AtlasRF (such as antennas, GPS receivers, AIS receivers, Remote ID receivers, and camera systems), nor to standard network equipment (routers, switches, PoE injectors) used for connectivity.
Geographic Operating Restriction
All BlackAtlas products — including AtlasRF, GridDown, GridDown Secure Messenger, and all associated hardware and software — are licensed and authorized for operation exclusively within the territory and jurisdiction of the United States of America, including the 50 states, the District of Columbia, and U.S. territories.
BlackAtlas products include geographic enforcement mechanisms. If the system determines that it is operating outside of United States authority, the system will automatically cease to function. This restriction is a condition of your license and exists to ensure compliance with U.S. export control laws, FCC regulations, and the operational parameters under which BlackAtlas products were designed and tested.
Operation of any BlackAtlas product outside of the United States without prior written authorization from BlackAtlas LLC constitutes a material breach of this EULA and may violate U.S. Export Administration Regulations (EAR) and other applicable federal law. BlackAtlas LLC assumes no liability for any consequences arising from the use or attempted use of BlackAtlas products outside of U.S. jurisdiction.

Updates
BlackAtlas may provide software updates for its products. For AtlasRF, software updates are provided at no additional cost for the lifetime of the product. BlackAtlas is not obligated to provide updates indefinitely and reserves the right to discontinue support for legacy hardware.
Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination of proprietary licenses, you must cease all use of the proprietary software.
