Acceptance of Terms

By accessing or using the BlackAtlas website (blackatlas.tech) or purchasing our products, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services or purchase our products.

Products and Services

BlackAtlas designs and sells hardware and software products for RF monitoring, tactical navigation, data destruction, and ground control applications. All products are described on their respective product pages. We reserve the right to modify product specifications, pricing, and availability at any time without prior notice.

Orders and Payment

• All prices are listed in US Dollars (USD) and do not include applicable taxes or shipping unless stated otherwise.
• Payment is processed securely through Stripe at the time of order.
• An order confirmation does not constitute acceptance. We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, or suspected fraud.
• AtlasRF units are made to order with an estimated 8–10 week lead time. Lead times are estimates and not guarantees.
• GridDown hardware devices typically ship within 2–3 weeks.

Shipping and Delivery

All BlackAtlas products are sold and shipped exclusively within the United States of America, including the 50 states, the District of Columbia, and U.S. territories. International shipping is not available. Risk of loss and title for items pass to you upon delivery to the carrier. Shipping times are estimates and not guaranteed.

Returns and Refunds

• AtlasRF hardware is made to order and is non-refundable once production has begun. Cancellations must be made within 48 hours of order placement.
• GridDown hardware (tablets, Sensor Hubs, and bundles) is non-refundable. Each device is provisioned with a unique authorization token tied to the proprietary software configuration. Once the device has been configured and shipped, the order cannot be returned or refunded.
• Digital software purchases (GridDown Software) are non-refundable once the download link has been delivered.
• Defective products will be repaired or replaced under our warranty policy at no additional cost.

Subscriptions and Recurring Payments

The AtlasRF Annual Support & Maintenance plan ($600/year) is a recurring subscription that renews automatically on the anniversary of your initial subscription date. Every AtlasRF purchase includes one full year of support and maintenance at no additional cost — this subscription is for existing AtlasRF owners whose included first year has expired.

• You will receive advance email notifications before each renewal (approximately 60 days, 30 days, and 24 hours prior to the renewal date).
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current paid billing period — support and maintenance will continue through the remainder of your paid year. No prorated refunds are issued for partial periods.
• To cancel, use the Stripe customer portal link provided in your subscription confirmation email, or contact info@blackatlas.tech.
• If renewal payment fails, BlackAtlas will attempt to collect payment per Stripe's retry schedule. If payment cannot be collected, the subscription will be canceled and support and maintenance will end.
• Your AtlasRF system continues to function indefinitely with its perpetual license regardless of subscription status. No features are disabled if you choose not to renew.

Warranty

BlackAtlas-manufactured hardware (AtlasRF) includes a 1-year limited hardware warranty from the date of delivery covering defects in materials and workmanship under normal use. Third-party hardware bundles (GridDown tablets, Sensor Hubs, software kit accessories) carry their original manufacturer's warranty; BlackAtlas warrants proper software installation and configuration for 30 days from delivery. Secure Messenger hardware (T-Deck CYPHER M8K) is sold directly by Rokland via an affiliate link and is not warranted, shipped, or supported by BlackAtlas — direct all hardware questions to Rokland. All software is provided "AS IS" without warranty. See the EULA for complete warranty terms.

Intellectual Property

All content on this website — including text, graphics, logos, software, and design — is the property of BlackAtlas LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

GridDown software is licensed under GPL-3.0 for non-commercial use. Commercial licensing is available separately.

Export Compliance & Geographic Restrictions

Our products may be subject to U.S. export control laws and regulations, including the Export Administration Regulations (EAR). You agree not to export, re-export, or transfer any BlackAtlas products to any country, entity, or person prohibited by applicable U.S. export laws without obtaining required authorizations.

All BlackAtlas products are licensed for operation exclusively within the United States of America. BlackAtlas products include geographic enforcement mechanisms that will cause the system to automatically cease to function if it determines it is operating outside of U.S. authority. Passive Operation & Prohibited Attachments

AtlasRF is a passive, receive-only RF monitoring system. You may not connect any radar, RF jammer, signal emitter, or other active transmitting equipment to AtlasRF without prior written authorization from BlackAtlas LLC. AtlasRF includes technical safeguards that may cause the system to automatically cease to function if unauthorized active transmitting equipment is detected. Violation of this requirement constitutes a material breach of the EULA and may violate federal law. See the EULA for full details.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKATLAS TECHNOLOGY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR PRODUCTS OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless BlackAtlas LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our products or services or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the state or federal courts located within the United States.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
